The U.S. constitution lets states fix their own election laws. It never once says when, if, or how that can be changed. But it does say: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." Since the power to change a state's election law is not delegated to the United States by the constitution, and is not prohibited by the constitution to the states, it is clearly within the sphere of the states. Those SCOTUS members who wish to prevent Pensnnsylvania form modifying its election procedures are clearly attempting to extend the power of the federal government, despite the clear statement of the constitution. What's particularly noteworthy is the hypocrisy involved: those are the very SCOTUS members who proclaim so loudly that they want to stick directly to what the constitution says, rather than "ruling from the bench". You, and they, are factually wrong. The 10th amendment is very clear on the issue. It is obvious that the goal is not to apply the constitution, but to get around the constitution, in order to prevent as many people from possible as voting, at least in a context (mail-in voting) where Democrats would appear to have an advantage.
Alito was speaking emotionally there, not factually. SCOTUS already deadlocked 4-4 on this issue. Thank you Roberts!
It is pretty amazing that for all of their crying, conservatives are the ones who are looking to circumvent the constitution and disrespect states' rights. Wait - not amazing, completely predictable from a bunch of fascists.
Not even close. Nothing prevents this from being brought to the USSC again (not that it'll be needed). Thank you ACB/Prez!
Or true Trump fashion, rather. He does like declaring victory without actually having to do the work of winning.
I hate it so bad when I'm right about things like this, but it was obvious. He did everything he could to discredit mail-in voting, and Republicans followed him massively, while large numbers of Democrats voted by mail anyway. Now he's going to try to keep those votes from counting. The Republicans are not satisfied with minority rule. They want to disenfranchise as many people as possible, so that nothing can challenge them. If Trump ends up being declared the winner by SCOTUS, even though an honest count clearly shows Biden winning both the popular vote and the EC, how do you think the rest of the world will react to the "president" of the United States being a man who clearly stole the election?
Called this one wrong. Looks like it'll be Biden. Consolation prize: Senate will keep us safe from most the worst of the crazy.
Actually, the problem is not that they counted the votes, but that they didn't limit themselves to just counting the right votes. People who are too illiterate to check the right box shouldn't be allowed to vote. So disregarding their ballots would only be fair. Unfortunately, those corrupt Democrats went ahead and counted all the ballots, and not just those that have the right boxes checked.
@tafkats, stop counting the ballots, I've already won with my prediction. I also got the tiebreaker right and I don't even need it!
Spot on. This has definitely been the most Teh Baba election ever. Shit. 306 electoral votes and a 6 million lead in the popular vote? I wouldn't call it a landslide, but it's landslide-ish. Um, by this I meant the electoral vote. I'll refine my prediction: Trump resigns on or before Dec. 19. Peaceful, smooth transition aside from MAGA Uprisings after the electoral vote. Anyway, I WON THIS CONTEST! BY A LOT!
You only won because my vote was never counted. I bet tafkats is going to claim he never even got it. I'm going to take this right to the Supreme Court, and fight for my rights! [Asyncritus turns his head to talk to his wife] "Dear, what do you think? Should my vote be counted, even though the election clerk claims he didn't receive it by the deadline?"
