Not necessarily. They have to opt out and even then it’s a process. Some states have yards where they remove the GP v protective custody distinction and just put people there who take prison seriously as an opportunity to program, earn credits, and get out early. In other words put prison politics aside and work instead. Who knows what Arkansas does. They probably use panopticons still.

Jokes aside, I do feel bad for his body falling apart like that. I'm just glad that for once Dayton actually listened when Garamet helped him get signed up through the ACA way back in the day before his now sustancial medical issues became a burden on his wife and newly married daughter.
The writer bears some responsibility but where the hell was the Arkansas Department of Child & Family Services? It seems that the authorities were willing to overlook the illegality of the situation and give the Duggars preferential treatment. Most likely because they were a white Christian fundamentalist family.

That is certainly part of it, but there were other things as well. When the show was launched Jim Bob was an elected member of the Arkansas state government. No doubt that played a part in it, as was the opportunity for folks to Point and Laugh at the Freak Show (PLFS). According to someone on a message board, I was a member of at the time, Michelle Duggar would use his status as a state rep, and their TV show to go around and beg for things from local businesses. Those businesses would get "free" advertising in exchange for giving the family stuff. For a variety of reasons, it didn't always work out that way, but assuming that the poster was telling the truth, then a number of folks in the area had excuses to cover up what was really going on.
